Welcome to N.NAW Automotive Art.

The terms “we”, “us” and “our” refer to N.NAW Automotive Art. N.NAW Automotive Art operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms & Conditions (“Terms”), together with any policies referenced herein, describe your rights and obligations when accessing or using the Services.

Please read these Terms carefully. They contain important information regarding your legal rights, including limitations of liability and other provisions that may affect you.

By visiting, accessing, using or otherwise interacting with the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm that you are at least the age of majority in your country, state or province of residence, or that you have reached the age of majority and have given permission for any minor dependants to use the Services on devices that you own, purchase or manage.

To access or use certain Services, including purchasing products through our online store, you may be required to provide information such as your email address, billing information, payment information and shipping details.

You agree that all information you provide is accurate, current and complete and that you have all necessary rights to provide such information.

You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activity occurring through your account.

You may not sell, assign, transfer or license your account to another person.

SECTION 2 – OUR PRODUCTS & ARTWORKS

We make every reasonable effort to display our artworks and products as accurately as possible.

However, colours, brightness, contrast, texture and overall appearance may vary depending on the device, display settings and viewing environment used to access our store.

Product imagery, framed mock-ups and displayed proportions are intended as visual references only and may not represent exact scale. Please refer to the selected product size for precise dimensions.

Fine-art prints may also exhibit minor variations resulting from the characteristics of the printing process, paper and other materials used. Such minor variations do not necessarily constitute defects.

Unless otherwise specified, N.NAW fine-art photographs are produced using archival-quality printing methods and materials as described on the relevant product page.

Certain artworks may be offered as limited editions. Where an artwork is described as limited to a specified number of prints across all sizes, that stated edition limit applies collectively across the available sizes.

Each applicable limited-edition print is individually numbered and accompanied by a Certificate of Authenticity.

Once the stated edition has been exhausted, N.NAW will not intentionally produce additional prints as part of that same limited edition.

Product descriptions, specifications, available sizes, materials and other product information may be updated where reasonably necessary. We reserve the right to discontinue products and to limit quantities offered to any person, geographic region or jurisdiction, subject to applicable law.

SECTION 3 – ORDERS

When you place an order, you are submitting an offer to purchase the selected products.

N.NAW reserves the right to accept or decline an order, subject to applicable law. Your order is accepted when we provide confirmation that the order has been accepted or has entered fulfilment, as applicable.

Payment must be successfully authorized and processed before an order can be fulfilled.

Please review your order carefully before submitting it. As our artworks are produced individually to order, production may begin shortly after an order has been accepted. We therefore cannot guarantee that cancellation or modification requests can be accommodated once production has begun.

If we are unable to accept or fulfil an order, or if an order needs to be modified or cancelled, we will attempt to contact you using the contact information supplied with your order.

Returns, refunds and exchanges are governed by our Return & Refund Policy, without prejudice to any mandatory consumer rights that apply to you.

Products purchased through the Services are intended primarily for personal use and not for unauthorized commercial reproduction or resale.

SECTION 4 – PRICES, PAYMENT & BILLING

Prices, discounts and promotions may change without prior notice.

The price charged for a product is the price displayed when your order is placed and will be shown in your order confirmation.

Unless expressly stated otherwise, shipping charges, customs duties, import charges and other applicable charges may be calculated separately.

Any applicable taxes will be handled as indicated during checkout and in accordance with applicable law.

You agree to provide current, complete and accurate purchase, payment and account information and to update such information where necessary.

By providing payment information, you confirm that you are authorized to use the relevant payment method and authorize us and our payment providers to process the applicable charges.

SECTION 5 – SHIPPING & DELIVERY

All N.NAW artworks are individually produced to order.

Production and fulfilment are handled with the assistance of professional fine-art production and logistics partners.

Production, fulfilment and delivery times displayed on the website are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Delays may occur due to production requirements, shipping carriers, customs clearance, public holidays, severe weather or other circumstances outside our reasonable control.

Shipping costs and available delivery options are displayed at checkout where applicable.

International orders may be subject to customs duties, import taxes, VAT or other charges imposed by the destination country. Unless expressly stated otherwise at checkout, such charges are the responsibility of the recipient.

Nothing in this section limits mandatory consumer rights concerning delivery, risk of loss or defective goods under applicable law.

SECTION 6 – INTELLECTUAL PROPERTY

All photographs, artworks, images, graphics, designs, logos, branding, text, videos and other original content made available through the Services are owned by or licensed to N.NAW Automotive Art / Nicholas Nawratil, unless otherwise stated.

Such materials are protected by applicable copyright, trademark and other intellectual-property laws.

Purchasing a physical N.NAW artwork transfers ownership of that physical copy only. It does not transfer copyright or any other intellectual-property rights in the underlying photograph or artwork.

Without prior written permission, you may not reproduce, copy, modify, distribute, publish, commercially exploit, license, sell digital or physical reproductions of, or create derivative commercial works from N.NAW content.

Nothing in these Terms grants you any licence or ownership interest in the N.NAW name, logo, photography or other intellectual property except as expressly stated.

All rights not expressly granted are reserved.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools or functionality offered by third parties.

We do not necessarily monitor or control such third-party tools.

Your use of optional third-party tools may be subject to the terms and privacy policies of the relevant provider. You should review those terms before using such services.

We may introduce new features, tools or resources in the future. Unless otherwise stated, such additions form part of the Services and are subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to websites, services or other online platforms operated by third parties.

We are not responsible for examining or evaluating the content, accuracy, security or practices of third-party websites that we do not control.

Accessing third-party websites is at your own discretion and may be subject to the terms and privacy policies of those third parties.

Questions, claims or concerns relating specifically to products or services supplied independently by a third party should be directed to that third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

N.NAW Automotive Art is powered by Shopify, which provides the ecommerce infrastructure used to make the Services available.

However, purchases made through our store are transactions directly between you and N.NAW Automotive Art, unless expressly stated otherwise.

Shopify is not the seller of N.NAW artworks.

Your use of certain Shopify services may additionally be subject to Shopify's applicable terms and policies.

SECTION 10 – PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information relating to your access to and use of the Services.

SECTION 11 – FEEDBACK

If you voluntarily submit reviews, suggestions, ideas, comments or other feedback (“Feedback”), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, display and adapt that Feedback for legitimate business purposes, including operating, improving and promoting the Services, subject to applicable law.

You confirm that you have the necessary rights to submit such Feedback and that it does not unlawfully infringe the rights of third parties.

We reserve the right, but are not obligated, to moderate or remove Feedback that is unlawful, abusive, defamatory, obscene, misleading or otherwise violates these Terms.

SECTION 12 – ERRORS, INACCURACIES & OMISSIONS

Occasionally, information made available through the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates or availability.

We reserve the right to correct such errors and update information where reasonably necessary.

If an error materially affects an order you have already placed, we will handle the matter in accordance with applicable law and contact you where appropriate.

You may use the Services only for lawful purposes.

You must not use the Services to:

• otherwise use the Services in a manner that could reasonably damage N.NAW, Shopify, our customers or other users.

We reserve the right to restrict or terminate access where we reasonably determine that these Terms have been materially violated, subject to applicable law.

SECTION 14 – AUTOMATED AGENTS

Automated or semi-automated software, services or AI agents accessing or interacting with the Services must comply with applicable technical restrictions, access controls and instructions made available through the Services.

No automated system may circumvent CAPTCHAs, access controls, robot-exclusion mechanisms or other technical measures designed to control automated access.

Automated systems may not scrape, reproduce, train on, commercially exploit or otherwise systematically extract N.NAW photographs, artworks or protected content without prior written authorization where such restriction is permitted by applicable law.

SECTION 15 – TERMINATION

We may suspend or terminate access to the Services where reasonably necessary, including in cases of material breach of these Terms, fraud, misuse, security threats or unlawful activity.

Termination does not affect obligations or rights that arose before termination.

Provisions which by their nature are intended to survive termination—including intellectual property, liability, governing law and other relevant provisions—will continue to apply.

SECTION 16 – WARRANTIES & DISCLAIMER

We take reasonable care in providing the Services and producing our artworks.

However, except for rights and warranties that cannot lawfully be excluded, we do not guarantee that the website will always be uninterrupted, error-free or available.

Information made available through the Services is provided for general informational purposes and may be updated from time to time.

Nothing in these Terms excludes or limits any statutory warranty, guarantee or consumer right that cannot legally be excluded or limited.

SECTION 17 – LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, N.NAW Automotive Art shall not be liable for indirect, incidental, special or consequential losses arising from the use of the Services or products purchased through them where such liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including any mandatory consumer protection rights.

SECTION 18 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify N.NAW Automotive Art against reasonable losses, liabilities or claims arising directly from your unlawful use of the Services, your material breach of these Terms or your infringement of third-party rights.

These Terms, together with the policies and other terms expressly incorporated by reference, constitute the agreement governing your use of the Services.

Nothing in this section limits rights that cannot be waived under applicable law.

You may not assign or transfer your contractual rights or obligations under these Terms where doing so would materially affect our rights or obligations without our prior written consent, except where applicable law provides otherwise.

We may transfer our rights or obligations in connection with a legitimate transfer or restructuring of our business, subject to applicable law and without reducing mandatory rights available to you.

SECTION 22 – GOVERNING LAW & JURISDICTION

These Terms and any separate agreements under which N.NAW Automotive Art provides Services to you are governed by the laws of Switzerland, excluding conflict-of-law rules to the extent permitted by applicable law.

The courts having jurisdiction at the registered place of business of N.NAW Automotive Art in Luzern, Switzerland, shall have jurisdiction over disputes to the extent permitted by applicable law.

If you are a consumer, this choice of law and jurisdiction does not deprive you of any mandatory consumer protection rights or jurisdictional protections available to you under the laws applicable in your country of residence.

Headings used in these Terms are included for convenience only and do not limit or otherwise affect the interpretation of the provisions.
